- In this work on which Jeremy Bentham (1748–1832) began in 1774 but never published during his lifetime, he exposes the fallacies which he claims to have detected in Blackstone's Commentaries, and criticises Blackstone's interpretation of the Common Law. Here Bentham provides important reflections on the nature of law, particularly on the nature of customary and of statute law, and on judicial interpretation in general. In his early legal-critical phase he challenges William Blackstone’s idealization of the English common-law system, attacking its reliance on precedent, vague principles, and reverence for tradition. Bentham argues that law should rest on rational, codified standards aimed at public utility, not inherited authority. The volume includes an introduction by C.W. Everett and retains the original scholarly apparatus. Historically, the work marks a turning point toward analytic jurisprudence and legislative reform, anticipating later codification movements.It was first printed in 1928 from the author's manuscript; with introduction and notes by Charles Warren Everett.
